About these Terms & Conditions

These terms and conditions of business are between Bridal Boudoir Photography in Dallas and Wichita , Alexandra Jo, Or any of Alexandra’s associates. (“Alexandra Jo Photography”), and a student and or client (“student or client”). They shall be deemed to have been accepted when the student uses the Alexandra Jo Photography website, enrolls in a free class, buys a class, or services.

a) “Agreement” means this agreement including the form that the student completes online or otherwise setting out the client/student’s requirements, including details of fees payable to Alexandra Jo Photography by the student.

b) “client/student” shall mean the individual that enrolls on the course or pays for a photo deposit of any type.

c) “Course” means the E-Learn courses, consisting of different modules, free blogs, or emails, provided by Alexandra Jo Photography under this Agreement.

d) “Site” means the website(s) operated by Alexandra Jo Photography for the purpose of running the E-Learn course or selling services. No variation can be made to these terms without the written consent of a Director of Alexandra Jo Photography.

Services

Under this Agreement the client/student will be provided with a login and password for access into the e-learn course, to complete all modules. After filling out a form and paying a deposit for photo or video services an email/ contract will detail out services agreement for each photo service bought.

Payment of Fee

The client/student must pay the photo or course fees in advance by credit/debit card. Fees are set out within the registration section of the website. By buying a course or service you agree to pay the entire amount due, and agree to cover any legal fees in the case you fail to pay.

 

Client/Student Obligations

The client/student agrees that for so long as it is party to this Agreement:

a) it shall not use the Services for any unlawful activity.

b) it shall ensure that all information that it provides to Alexandra Jo Photography is accurate, does not contain any misleading items or misrepresentations, does not infringe any other person’s rights, and does not breach any applicable law;

c) it shall upload to the Site or Services any material nor uses the Site or Services for the distribution of any material, which Alexandra Jo Photography in its sole discretion considers offensive, immoral, abusive, indecent or otherwise undesirable, and shall not use the Site or Services or any information from them for spamming or any other purpose not approved by us;

d) it shall not attempt to access data or any parts of Alexandra Jo Photography’s system which it is not authorized to access;

e) it shall provide such information as Alexandra Jo Photography may reasonably request to confirm that all information supplied is correct and/or that it is not in breach of the Agreement;

f) it shall defend and indemnify Alexandra Jo Photography against all claims, losses, damages, liabilities, costs, and expenses arising as a result of its breach of this Agreement.

 

Alexandra Jo Photography Rights

a) Alexandra Jo Photography may suspend or block the client/student access to the Services at any time if the student breaches any of the terms of this or other signed Agreement at her sole discretion.
b) Alexandra Jo Photography will be developing its web-site and service further, so reserve the right:

to make changes to the Site and Services; and

to render the Services unavailable for periods where this is necessary for development or maintenance.

 

Confidentiality

The parties agree that they will only use the others’ confidential information for the performance of this Agreement and will not disclose it to other parties other than as necessary for the performance of this Agreement or as required by law. All emails submitted with be used throughout the Alexandra Jo Photography systems to keep in touch.

 

Liability

a) Alexandra Jo Photography will endeavor to keep the Services working as often as possible but will not be responsible for any time for which it is unavailable, whether due to telecommunications or internet failures or otherwise. All users are responsible for taking appropriate measures against the risks associated with using the internet and downloading the content, pdfs, or photos/ video as allowed, including viruses and other harmful mechanisms, and Alexandra Jo Photography will not be liable to the student for any loss, damage or liability caused by any such item. Alexandra Jo Photography’s entire liability to the student/client, whether in contract, tort (including negligence) or otherwise, shall be limited to the fees paid by the student to Alexandra Jo Photography in the twelve months preceding the date on which such liability arose. Alexandra will not be liable, and no funds will be returned if an issue or concern is brought up after (30) days from date of purchase. All downloads, pdf, graphics, photos, or video should be downloaded by the client/student when allowed within (30) days of purchase.

b) In no event will Alexandra Jo Photography be liable to the client/student for any indirect, consequential or special loss or damage, including lost profits, sales, business, data, goodwill, savings or otherwise, however caused (including by negligence).

c) Nothing in this Agreement limits Alexandra Jo Photography’s liability for death or personal injury caused by its negligence, or for fraudulent misrepresentation.

d) If any of the preceding sub-Clauses is found invalid or unenforceable, the remaining sub-clauses remain in full force and effect.

 

General

a) All copyright, trademarks, patents, database rights and other intellectual property rights in the Site, Services and underlying functions are the property of Alexandra Jo Photography or its licensors, and the client/student must not copy, alter or otherwise infringe any such rights.

b) Notices must be sent in writing or by e-mail to the relevant party’s details set out in the registration form or otherwise properly notified to the other party. Notices are deemed received two working days after posting, and twenty four hours after dispatch by e-mail.

c) This Agreement is the entire agreement between Alexandra Jo Photography and the client/student, and works alongside the required photo/video contact per service bought. No other verbal contracts will cause this or a photo contract to be invalid.

d) This Agreement is governed by USA laws, specifically Texas, and the student submits to the exclusive jurisdiction of the United States/ Texas courts. Alexandra Jo Photography pick venue of court.

e) If you are below 18 then you can NOT use this site. Do NOT enroll if you are below the age of 18.

By registering to use this site you meet the above criteria and agree to abide by all of the above rules and policies.
